I have recieved a payment demand

The company that you owe money to has chosen to use us to manage their demands for payment. When sending a payment demand on someone else’s behalf a debt collection permit is required issued by The Swedish Data Inspection Board.

When you have received a debt collection demand a chain of events begins. If full payment is made the case is concluded, but if no payment can be made various authorities are brought in, which has future consequences.

No. A record of non-payment is issued for individuals only after an injunction by the Enforcement Authority (Kronofogdemyndigheten). Your record of non-payment is then kept for 3 years.

With regard to companies the record of non-payment is kept for 5 years. Even an application for a payment injunction is registered as a record of non-payment.

The debt collection demand in itself does not result in a record of non-payment.

The debtor is obligated to pay debt collection fee for a debt collection demand issued in accordance to 5 § collection act and submitted or sent to the debtor. The debt collection fee is currently 180 SEK.

In the event that you have payed debt, you may still be obligated to pay the debt collection fee. According to The Swedish Data Protection Authority (Datainspektionen) a payment demand sent before or the same day as the payment made by the debtor is registered by the creditor is valid and the creditor is entitled to compensation.

If the debt is for a rental apartment, the creditor is entitled to the payment collection fee if the payment demand was sent before, or the same day as, the payment order was registered at the clearing house (post- or bankgirot).

I have an unpayed claim

No. There is no law dictating that a creditor must send a payment reminder before initiating debt collection. However, we recommend that a reminder is sent in order to maintain a good relationsship with your customer.

If your customer contests the payment demand, the usual debt collection process whereby a debt collection demand is sent and an injunction to pay is applied for at the Enforcement Authority (Kronofogdemyndigheten). We can, however, assist in court proceedings or in reaching a settlement with your customer.
